Taxation of Swiss AVS pensions in Spain

Spain and Switzerland have signed a tax treaty that specifies the taxation of pensions according to their origin:

  • AVS pension from a job in the private sector:

    The AVS pension from private sector employment is considered a private pension (Article 18 of the convention). It is taxable in Spain, where you will be a tax resident. You must therefore declare it on your Spanish tax return.

  • AVS pension from employment in the public sector (civil servant, Swiss administration):

    If you receive an AHV pension for work in the Swiss civil service, this pension is generally taxable only in Switzerland and tax-exempt in Spain (Article 19 of the treaty).

  • Swiss private pensions (second and third pillar):

    They are also taxed in Spain as investment income or annuities, unless the taxes were already paid in CH.

It is therefore crucial to identify the origin of your pension to optimise your taxes.
